Help for Relocation Cases Involving Child Custody
Once a divorce is finalized, one or the other party may see the need to move and relocate their life. If couples share children, then issues concerning child custody and/or child support must be modified to reflect the move. The relocating parent must file a petition with the court for approval first if they intend to relocate more than 50 miles away from their current home.
If you need assistance with relocation and modifying court agreements, contact one of our Miami family law lawyers at Mitchell & West LLC. We can ensure that your move abides by Florida laws and that the issues affected by your relocation are effectively resolved.
Relocation can be done in two ways:
- Relocation by agreement, where the parents both agree to the move and enter into a written agreement, but is still subject to court approval.
- Relocation by petition, where the relocating parent notifies the other parent and submits a petition to the court for permission. The petition will include details of the move and time-sharing and visitation details.
- Relocation hearing is required if one parent does not agree to the move. The parents will then need to attend a relocation hearing for the court to decide on whether the move is in the child's best interests.
